Where to send notices
Send takedown notices and counter-notices by email to [email protected], with the subject "Copyright notice" or "Counter-notice". You can also use the contact form (topic "Copyright"). We review every complete notice.
What a takedown notice must include
Following 17 U.S.C. § 512(c)(3), please include:
- A physical or electronic signature of the copyright owner or a person authorized to act for them.
- Identification of the copyrighted work claimed to be infringed (or a representative list, if there are several).
- Identification of the material claimed to be infringing and information reasonably sufficient for us to locate it (for example, the ClipSocial URL or post ID).
- Your contact information: address, telephone number and, if available, email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner.
What we do
When we receive a complete notice, we promptly remove or disable access to the material stored on ClipSocial and tell the user who uploaded it. Content already published on another platform must also be reported to that platform. We end the accounts of repeat infringers in appropriate circumstances.
Counter-notice
If you believe your material was removed by mistake or misidentification, send a counter-notice (following 17 U.S.C. § 512(g)(3)) that includes:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district of your address (or, if you are outside the United States, any judicial district in which the service provider may be found), and that you will accept service of process from the person who filed the original notice or their agent.
We forward the counter-notice to the person who filed the original notice. Unless they tell us within 10 business days that they have filed a court action, we restore the material in 10 to 14 business days after receiving the counter-notice.
False claims
Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages.
